Please review these Terms of Service ("Terms") carefully prior to utilizing the digital directory, acoustic indexing records, and VIP reservation brokerage services rendered by Buzzpocketloopster Media GmbH ("Buzzpocketloopster", "we", "us"). By interacting with buzzpocketloopster.garden, you acknowledge your unconditional agreement to be bound by these provisions under the laws of the Federal Republic of Germany.
1. Scope of Digital Directory Services
Buzzpocketloopster operates an architectural curation and informational directory covering high-altitude nightlife spaces, clubs, and rooftop lounges situated within Berlin, Hamburg, Frankfurt am Main, and Munich. Unless explicitly stated in a dedicated bilateral agreement, Buzzpocketloopster functions as an independent publishing intermediary and concierge coordinator, and does not operate as the physical operator or licensee of the listed rooftop properties.
2. Intellectual Property & Architectural Renderings
All graphical assets, including but not limited to the real-time Three.js 3D WebGL skyline algorithms, custom SVG identity iconography, data-grid card architecture, telemetry matrices, photographic representations, and structural acoustic whitepapers, are the exclusive intellectual property of Buzzpocketloopster Media GmbH or its licensors protected under German Copyright Law (Urheberrechtsgesetz - UrhG). Systematic extraction, web scraping, commercial reproduction, or unauthorized framing without prior written consent is strictly prohibited.
3. VIP Reservation Coordination & German "Hausrecht" Disclaimers
While Buzzpocketloopster transmits reservations and concierge table clearances to partner venues (e.g. Klunkerkranich, House of Weekend, Roomers Skylight), admission to any German nightlife establishment is subject to the supreme domestic authority (Hausrecht) of the individual venue operator pursuant to Section 903 of the German Civil Code (Bürgerliches Gesetzbuch - BGB).
- The physical door selectors and security staff of each respective club maintain autonomous, final discretion regarding patron admission.
- Possession of a table reservation confirmation does not override house policies regarding dress etiquette, sobriety, anti-discrimination guidelines, minimum age requirements (typically 18+ or 21+), or capacity safety cutoffs under local municipal fire ordinances (Versammlungsstättenverordnung).
- Buzzpocketloopster accepts no liability for admission refusal grounded in local door selector decisions or patron non-compliance with venue codes of conduct.
4. Weather-Dependent Rooftop Operations & Force Majeure
High-altitude outdoor terraces operate under strict meteorological safety standards. Open-air decks may close unexpectedly due to lightning strikes, severe convective storms, or gale-force winds exceeding Beaufort scale force 7. In such events of force majeure (Höhere Gewalt), venues will typically relocate guests into indoor sound-isolated penthouses where spatial capacity permits.
5. Limitation of Liability
Buzzpocketloopster Media GmbH shall be liable without limitation solely for damages resulting from injury to life, body, or health arising from an intentional or grossly negligent breach of duty. For slight negligence, our liability is restricted strictly to foreseeable, contract-typical damages arising from the violation of material contractual obligations (Kardinalpflichten). We accept no liability for third-party acoustic rig modifications, pricing alterations, or sudden cancellation of lineup events by club promoters.
6. Governing Law & Judicial Jurisdiction
These Terms of Service and all legal disputes arising from use of buzzpocketloopster.garden shall be governed solely by the substantive laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Insofar as permitted by law, the exclusive venue of jurisdiction for all disputes shall be Berlin, Germany.
